Administrative disqualification is an authority prescribed in the Traffic Ordinance, which allows a police officer to disqualify a driver from holding a license for a specified period even before the indictment is ascertained. It is intended to provide an immediate response in the situations prescribed by law. The decision is not a conviction and is not the final punishment, but as long as it is in force it is prohibited to act contrary to it.

Upon making a decision, the date of its commencement, withdrawal, the attribution offense, the details of the hearing and the duty of depositing the license must be kept. When may an officer impose administrative driving disqualification?

The Traffic Ordinance lists offenses and situations in which a driver may be called to a hearing before an officer and consider disqualification. Among other things, certain traffic offenses and accidents in which an injury occurred. The type of incident affects the scope of the authority and the period. The updated version of the Ordinance should be read and not relied on a partial list on a commercial site.

The periods recognized in the Ordinance may be 30, 60 or 90 days depending on the type of case, for example an offence from the list, an accident in which a person is injured or property is damaged, and a fatal accident. The exact classification depends on the conditions in the Law. Since the law is updated, the Articles and the period on the day of treatment and the document given to the driver must be verified.

How the hearing is conducted before an officer

The hearing is intended to allow the driver to make his claims before making a decision. The officer examines the initial infrastructure and the question of whether there is a danger that warrants disqualification. The driver can present relevant circumstances and evidence. The hearing is recorded, so the hearing should not be considered informal and a version that is not accurate should not be provided.

If the driver does not report for a hearing after a lawful summons, a decision may be made in his absence according to the order. Therefore, the summons should not be ignored. If there is a real difficulty in reaching out, the timer should be approached and the options checked. An employment claim may be relevant, but it does not replace an examination of the evidence and the risk to road safety one.

The summons and the documents provided should be brought in. A medical document, work permit or special circumstances information should only be submitted if they are genuine and relevant. Source documents may not be submitted unless the court has otherwise ordered.

The application is not an ordinary appeal of conviction, as a trial has not yet taken place. The court examines the administrative decision within its jurisdiction, including the infrastructure and the risk to road safety. The formulation of the request should distinguish between a evidentiary claim, a defect in the procedure and personal circumstances. The court should not be guaranteed to shorten or cancel the disqualification.

Where and how the application is submitted

The judiciary states that the application is submitted in the court in the district where the offence was committed. The termination of the administrative driving disqualification period does not cancel the indictment, and the cancellation of the disqualification does not necessarily cancel the charge. On the other hand, the period of disqualification already served may be relevant later, but the significance is determined by court decisions.

Therefore, it is important to manage both routes: do not wait for the main discussion if there is a legal option to request cancellation, and do not neglect the indictment because the license has been returned. Each document will receive a folder and date. This arrangement prevents missed deadlines and allows for understanding which decision belongs to which procedure.

Common mistakes following disqualification

The most serious mistake is driving during the period of disqualification. Other errors are failure to deposit, loss of the hearing form, waiting until near the end of the period, and making a general request that only speaks of the need for a vehicle. A personal need is important, but the court also examines the infrastructure and risk.

Another mistake is reliance on another driver's case. Two strikes in the same alleged offence can be based on evidence and a different transitory record. Neither does a previous result guarantee a similar result. The report, the hearing, the driving history and the concrete circumstances must be reviewed.

Prepare a request to cancel or shorten the disqualification

A request to the court should first present the decision that is asked to change: who is a sculptor, when, for what period, for what event and when the license was deposited. Attach the relevant form and credentials and make sure that the details match the invitation. A request that does not explain what in the evidentiary infrastructure or in the risk to road safety assessment warrants intervention may remain a mere description of personal difficulty.

On the evidentiary plane, the report is examined, the circumstances of the stop or accident, the identification, the results of tests and any material provided. It is not necessary to argue that every missing detail "disqualifies the disqualification"; the gap must be explained as to the probable basis for the decision. On the risk to road safety plane, the type of alleged offence is examined, the driving circumstances and the traffic transfer, without concealing prior convictions or infractions.

Personal circumstances are presented in precise documents. A hired driver can attach an employment permit explaining his role and the effect of the disqualification; treatment of a family member is backed by a suitable document; a medical need is described without details beyond the required. Also good infrastructure does not guarantee cancellation, because the court balances it against public safety and the material in front of it.

There is significance to the timing. Administrative disqualification is relatively short for the main procedure, so delay may make some of the request less practical. However, speed does not justify submission without the form or without understanding when the period began. The official filing service, the competent court and the possibility that a hearing has been scheduled, are reviewed and are acting according to court decisions.

After filing, the driver is not allowed to drive unless an express decision has been made that allows it and the license has been returned accordingly. The case is followed, the filing permits are kept and the original documents are discussed. At the same time, the indictment itself is handled, since a decision that shortens an administrative driving disqualification does not terminate the traffic procedure and does not determine its outcome.

If the disqualification is concluded before a decision is made, the entire case is not assumed to be closed. Checking how the license is returned and what is required according to the decision and the law, and continuing to follow the order for the main procedure. Each day that a documented driving was prevented, but the question of the deduction of the period or its meaning below is determined by the law and the court and is not an interest in self-calculation.

In the event that a vehicle is also disqualified or another administrative measure is taken, any decision is handled according to its documents. Returning a license does not automatically return a vehicle, and vice versa. The separation of decisions is especially important when the owner is not the driver.
